Disney has been named in a lawsuit filed by a woman claiming a Typhoon Lagoon waterslide left her severely injured.
The suit alleges the woman rode the slide in 2019 while on celebrating her 30th birthday on a visit with her family and walked away with significant trauma.
According to the Orlando Sentinel, a woman has filed a lawsuit against Disney claiming that she suffered “severe gynecological trauma” following a trip down the Humunga Kowabunga waterslide at Typhoon Lagoon water park.
The suit was filed in Orange County Circuit Court and plaintiffs, Emma and Edward McGuinness, are seeking at least $50,000 in damages from Walt Disney World as a result of the alleged injuries she sustained.
Attorney Alan Wagner of Tampa filed the suit that claims Emma McGuinness received the injuries after sliding down the 214-foot-high waterslide on a 2019 trip with her family for her 30th birthday.
“At the top of The Slide, riders are instructed to cross their legs at the ankles… Riders are not told why their ankles need to be crossed, the importance of doing so, or the risks of injury if one’s ankles become uncrossed,” the suit says.
Allegedly, Ms. McGuinness “went airborne” during her trip down the slide, forcing her ankles apart, and her impact into standing water at the end of the slide “caused genital lacerations and internal organ damage, requiring two hospital visits for treatment.”
The suit goes on to say she suffered “permanent bodily injury” including “a full-thickness laceration causing [her] bowel to protrude through her abdominal wall.”
The suit is contending that Disney didn’t provide protective clothing like shorts, failed to warn the plaintiff about the dangers of the slide, and failed to maintain it preventing riders from going airborne.
In addition, the suit claims Edward McGuinness suffered the loss of his wife’s “care, comfort, consortium, support, and services.”
At this time, Disney has yet to release a statement, but we’ll update you if that changes.
